Terms and Conditions

1. Background

These general terms and conditions apply to all products, services and deliveries obtained through black&schweiz ("we" / "us"). By submitting an order you (the "customer") expressly agree to these terms. They apply only to customers who are consumers.

Individual side agreements are valid only with written confirmation from black&schweiz.

2. Contract

A purchase contract is concluded when the customer has received an automated order confirmation by email from black&schweiz. With that confirmation the contract is in place; changes and cancellations can no longer be accepted from this point on.

The customer must be at least 18 years old to place orders through the website. black&schweiz does not accept credit purchases by persons under 18. We reserve the right to decline a customer’s order for demonstrable reasons.

We accept orders and delivery addresses within Switzerland only.

3. Copyright

The author of the photographs and products offered on black&schweiz is black&schweiz itself or the frame partner. The delivered end product is therefore free of third-party rights.

By purchasing a product containing photographs made available on black&schweiz, the customer acquires ownership of the physical product only. Rights of use for reproduction of any kind, distribution, modification or making available to the public are not included and are strictly prohibited.

4. Offer and products

Prices in our offers and order confirmations are in CHF (Swiss francs) and are binding in principle. Prices include payment and shipping fees. black&schweiz is not liable for VAT.

We aim to depict our products as faithfully as possible. Product images may differ from the actual product depending on the screen used and its colour settings; they are for information only. No liability can be accepted for the accuracy, completeness or timeliness of the information. black&schweiz reserves the right to change prices and its assortment at any time.

Our prints are produced on 200 g uncoated premium paper with a smooth surface.

Our picture frames come in three sizes. The stated measurements refer to the inner dimensions of the frame; outer dimensions can be provided by email on request. The frame is made of wood and is black. Frames in size 20x30 cm have an integrated support so they can be placed on a shelf. All frames are designed to open easily so posters can be inserted. Frames can be hung either portrait or landscape.

5. Delivery and delivery times

Stated delivery times are not binding. black&schweiz always endeavours to meet the delivery times given on the website. The product is produced upon conclusion of the contract. Unless otherwise agreed in writing, delivery is generally ex works from black&schweiz. If in exceptional cases we cannot meet the agreed deadlines, we contact the customer by email or telephone and the customer is refunded.

Shipping is handled by Swiss Post. Goods are to be checked for accuracy, completeness and integrity immediately upon arrival. Transport damage must be reported and documented immediately, at the latest within five calendar days. black&schweiz endeavours to produce and deliver all ordered products as quickly as possible. Delivery normally takes 7–10 working days. As stated above, deliveries are limited to delivery addresses within Switzerland.

In the event of delivery disruptions not culpably caused by black&schweiz and outside its influence, we reserve the right to withdraw from the contract, provided the impediment is not of a temporary nature, without any obligation to pay damages. This applies in particular to events of force majeure. For the duration of the impediment we are not in default of delivery. Payments already made are refunded in the event of withdrawal.

As long as you are in default of payment, all services towards you are suspended. Payments are offset in chronological order against open claims, interest and open costs.

6. Payment terms

Shipping takes place only after successful verification of the credit card or PayPal details. Payment is possible by credit card or PayPal. All prices are end-customer prices, stated including packaging and shipping.

Additional shipping costs arising from incorrect delivery addresses or address details are charged to the customer, provided the customer is responsible for the incorrect information.

7. Ownership

The goods remain the property of black&schweiz until full and final payment and delivery.

8. Vouchers

Vouchers are valid only within the stated period and can be redeemed only once within an online order. Vouchers cannot be paid out in cash. black&schweiz reserves the right to adjust or withdraw discount campaigns at any time.

9. Returns

The right of withdrawal and return is excluded where products are made according to the customer’s specifications and tailored to their personal needs (all products at black&schweiz are made on demand, to order). For this reason all photo products made by black&schweiz are excluded from the right of return.

10. Links

black&schweiz may provide links to other websites over which black&schweiz has no control, and companies over which black&schweiz has no control may provide links to this website. Although black&schweiz seeks to ensure that it links only to websites with provisions on the protection of personal data and security similar to those set out in the black&schweiz privacy policy, black&schweiz is not responsible for the protection or confidentiality of personal data the customer provides on other websites. Customers should be careful and read the provisions on personal data that actually apply to the website in question.

11. Liability

Within the limits permitted by law, black&schweiz excludes all liability for the products sold and delivered.

12. Final provisions

All legal relationships are governed by Swiss law. black&schweiz reserves the right to change these general terms and conditions at any time. The binding version of the terms is available for inspection and printing at www.blackandschweiz.com. Place of jurisdiction is the registered office of black&schweiz. The language available for concluding the contract is German.
